Every year, people from India, Sri Lanka, Bangladesh, and other countries pay agents the equivalent of tens of thousands of euros, convinced a tourist visa is the first step to a job and a new life in France. Before paying anyone, understand exactly what this visa does — and does not — allow.

1Understand What a Tourist Visa Actually Is, First
A Schengen short-stay (“tourist”) visa is issued to let you visit France — it is not a visa that lets you settle here permanently. It allows a maximum stay of 90 days within any 180-day period, and it carries no right to work of any kind. Understanding this clearly, before you travel, is the single most important thing to get right.
2What Happens the Day Your Visa Expires
Once your 90 days are up, you become undocumented. No employer can legally hire you, most landlords won’t rent to you, and you lose access to standard healthcare.
Working without authorization is a criminal offense for the worker (Code du travail, art. L.8251-1) — and the employer faces heavy penalties too.
3The Real Risk: OQTF and a Ban on Returning
If checked by police, you can be issued an OQTF (order to leave France), often paired with an IRTF — a ban on returning to France, sometimes the whole Schengen area, for up to 3 years (CESEDA, art. L.612-10). This can block any legitimate visa in the future, even once your situation changes.
4Years Undocumented Does Not Lead to Automatic Status
Under the current framework (circulaire du 23 January 2025), general regularization (admission exceptionnelle au séjour) now requires 7 years of continuous, well-documented presence — and remains entirely at the prefect’s discretion, never a guarantee.
5Without French, Your Situation Can Become Exploitative
Not speaking French leaves you unable to look for proper work, assert your rights, or ask for help. This is exactly how some employers underpay, overwork, and control undocumented workers — effectively trapping them. Think this through completely before you travel, and prepare with the language if you can.
6How a Real Work Visa Actually Works
France has no system where you simply “buy” a work visa, unlike labor arrangements in some other countries. The legitimate process is:
- A company in France selects you for a job.
- That company applies for your work authorization (autorisation de travail) from French authorities.
- Once approved, the company sends you that authorization.
- You use it to apply for your visa at the French embassy in your home country.
If anyone tells you they already “have” a work visa for you in exchange for a large sum of money, do not believe them. Verify directly with the French embassy or consulate if you are unsure.
